Legal Question in Intellectual Property in Missouri

Using a name to sell a product without permission

My step-father's father is a world-renowned craftsman in the pool table industry. He is retired now, but for almost the past ten years a certain company has used his name as part of their product pitch. The company has never compensated him for using his name as their endorsement, and though he isn't world renowned, he is well known within the community.

My step-father feels there has been major injustice done, and is trying to convince his dad to sue the company. What is the law in Missouri on this issue? Is there any sort of precedent or would filing a suit be a waste of time?

Re: Using a name to sell a product without permission

It really depends on how your step-father's father's name was used. i would need more information. It could either be a state specific tort issue or a trademark issue. feel free to email me at [email protected] with more details. sorry for the short response, but information is needed.
