tenant leave with the stuff

I have a month to month commercial tenant when I ask them to leave next month (I sent out 30 days notice). they had installed a new carpet last yrs. when they leave do this tenant have the right to bring the carpet with them. Thanks

It depends on the terms of your written lease. Although the tenant is now month-to-month, in most cases it started with a lease, and that lease will likely control. In the event that it does not, then the tenant likely cannot take the carpet with them because while fixtures are the property of the tenant, items affixed permanently to the property (like carpet) stay. Of course, if the carpeting is really just an area-type rug, then they could roll that up and take it with them.
