parents or school liable for injury caused by another child's actions?

My child was injured at school when another child threw a horseshoe post in the air and it hit him in the head. He had to be seen by a physician at an urgent care center and a head CT scan was performed to make sure he did not have a skull fracture or intracranial bleeding. Our insurance deductible is $400.00. The child voluntarily came forward and admitted he non-maliciously threw the post in the air � and my son agrees it was not meant to hit him or anyone else. The school administrator contacted his parents to notify them of this incident. Can the child�s parents or the school be held liable for our deductible?

Yes- It is possible to force the district to contribute to the cost of care, but it is often cost prohibitive to do so. Have you tried asking the district to contribute? They may have insurance to cover this incident.
