who is responsible in this circumstance and can the doctors be sued for negilence question can you sue a radiologist when he misreads an xray and tells the primary physician a diagnosis that the primary physician does not even suspect in the diagnosis. explanation a radiologist read my chest xray as pnuemonia, yet the primary physician and er doctor felt it was a pulmonary embolism. since my main diagnosis was deep vein thrombosis. the reason this is asked because three days prior to an admission i was treated for pnuemonia by an xray that was taken. three days later i was in er with a diagnosis of a deep vein thrombosis and with the research i have done the radiologist rules out pnuemonia with a dvt and pe does not diagnosis it. even though i was treated for a dvt and pe is the radiologist responsible for the misdiagnosis. is the hospital i went to any way responsible for the diagnosis the er dr and primary doctor says in was a dvt with a questionable pe. and that was because of the pnuemonia xray of three days prior to the dvt diagnosis.

Physicians and hospitals can be sued for deviating from the Standard of Care. In essence they have to act in a manner other than any reasonable prudent health care giver would act. From the circumstances you have described, there is a potential cause of action, however, the damages are what usually drive these cases.
