Legal Question in Medical Malpractice in Missouri

Suicide attempt , antidepressant & valium

On Jan 11th, my 24 yo son put a gun in his mouth and fired a 40cal hollowpoint into his head. He IS alive and walking and talking. He is not the same, though. He had been taking effexor (antidepressant) approx 3 weeks. Two days prior to attempt, his dr prescribed 90 10mg valium knowing he was depressed and had hx of self-medicating. He took several of the valium Tues. nite and Wednesday and Thursday shot himself. I don't think he would have if not for the medicines. It has been rather devastating to our family and friends. Do you think I have a legal case against the prescribing Dr?

First, I am very sorry for the trauma you've suffered with your son. Suicide cases are very difficult, and it is rare to prevail because the acts of the person pulling the trigger are usually thought to supravene the negligence of the provider. However, if you feel strongly, it would be a good idea to obtain all the medical records and go see an accomplished medical negligence attorney.
