can the commander of the soldeir who is assigned to the unit but is attached out to another unit give UCMJ actions?

The answer is that it depends. Oftentimes, attachment orders will spell out whether the command to which you are attached has UCMJ authority over you or not. If not, then the unit commander to which you are assigned (versus attached) may continue to have UCMJ authority over you. This is certainly an issue you need to have resolved before making a decision on how to proceed in the face of a charge(s).
