Legal Question in Personal Injury in Missouri

College Student injured during game

A female college student was injured during a basketball game. The injuries she sustained were... a bloody nose, bruised arm, tooth knocked out, and a split lip which required 3 stitches. She now needs to see an oral surgeon to repair her tooth and gums. My question is... Does she have a case against the school, the reason for me asking is, after she was injured she received no medical attention while at the game. When she was standing in the hall (bleeding mind you) she was told to move. Then while cleaning herself up in the restroom, a man comes in and tells her she has to leave because people wanted to use the restroom. She got no assistance from school/athletic staff or medical treatment until her friends parents came and picked her up to take her to the hospital. Shouldn't they have AT LEAST called her an ambulance or made sure she was ok. I would appreciate any response on this matter.

Re: College Student injured during game

There is no legal liability since their lack of attention, while certainly upsetting, caused no physical injury.

Re: College Student injured during game

For purposes of your question, I assume she was a student athlete, and the school had sponsored the game. Certainly they should have transported her, and certainly a formal complaint should be made. But since the injury was sustained in a game, and since nothing they did made the injury worse, there is probably not a lawsuit.

I would speak to the athletic director and ask for closer supervision of students medical needs.

Re: College Student injured during game

I do not think there is a viable case against the school for what it did after the incident, as this did not cause the injury. But I do not know enough about the incident to give a definite answer.
