Legal Question in Personal Injury in Missouri

My husband was killed while riding his motorbike just before christmas of 06. He left behind a wife 3 children and 2 grand children. We are still devastated but need closure on this terrible situation. I am 50 and don't have many years left but I want to make sure that my children get what is due. we have filed suit for the death and the insurance company has offered to pay the policy limit which is $250,000.00.This has to be approved by the court and my lawyer is setting a hearing. I would also like to help take care of my husbands mother who is 69 and in poor health. After the lawyer has his 33% I don't see much left. Is my husbands insurance co. liable too? My sister said that I should sue the driver too. It seems as though the insurance co. runs the show. What else should I ask about?

I am sorry to hear of your loss, but am concerned as to why your aren't asking the lawyer you hired these questions? As for your husband's insurance company it depends on whether he carried underinsured motorist coverage. If he did, then yes, you can get that policy limit as well. Your attorney really needs to make certain that what they are claiming as their limits is really what they have. Also, was the guy who hit him employed and was he driving for his employer when it occured? If so, then go after his employer.
