Legal Question in Product Liability in Missouri

Failed knee prosthesis broke off

I had a total knee replacement in 2003, nothing about the recovery went right. The Ortopedic Surgeon has not dismissed me to go back to work, but has rarely (maybe 1 in 30 times) examined or looked at or manipulated, or touched my leg at multiple office calls. In July 2003, TKR Oct. 2003, I heard and felt a big noise, called the surgeon, no call back, knee felt like something was floating in it, called the Ortho office again, no call back. At next appt. explained to OS that something was wrong with my prosthesis, he said ''Nothing is wrong with that knee'' I asked for xray, he returned and said ''IT appears that a screw has backed out of the knee and is floating in the knee.'' Had revision Oct 2004, with replacement of spacer, and removal of screw that broke off. Physcian refused to give me back the prosthesis parts, the hospital promised me them prior to me signing the permit, and then administration refused to even talk to me about them. I called the company who made it, and eventually got them back. OS said ''Tough, you can't have them back'' TO date, Leg remains warm, swollen (4-6 inches bigger than other leg) Pain is still intense prevents sleep. Physcian NEVER looks at, touches, or examines leg. Just refers to various dr.Thanks,
