Legal Question in Real Estate Law in Missouri

Eviction proceedings for property damage

We had a small gathering at our apartment which we rent month to month and someone broke a whole in the door. Now we are getting evicted for damaging the property. What kind of notice should we legally recieve for the date of eviction?

Re: Eviction proceedings for property damage

Do you have past due rent or fees or is this damage the only reason you're being evicted? If it is because of the damage, you need to look at your lease and what it says about terminating the lease as a result of tenant's breach based on damage to the apartment. If there are other bases for your eviction (ie late payment), then the issue becomes more complicated. Typically, the lease will set out notice terms prior to any eviction proceeding. Good luck. If you need further assistance, I would suggest you hire an attorney to review the lease for you.
