Legal Question in Real Estate Law in Missouri

my husband and i are being sued by our neighbors for our driveway. they have their own road but they want ours also. is there a law in missouri that will protect us? is there anything we can do to prevent this from happening? the driveway also serves as an access for the neighbors, it goes through the middle of our property right next to our home. it is not an easement, the previous owners simply felt sorry for them one winter because their road was in need of repair and let them cross this property. we let the neighbors know that we were going to install gates in order to provide more grazing area for our livestock and they said that they would knock them down if we put them up and shortly after that we were served with papers stating they were suing us for the driveway. we live in a rural area in southwest missouri. we are in desperate need of help.

I would suggest that you make an appointment with a local lawyer to review the lawsuit and also whether you have title insurance which would ensure the boundary lines of your property. If this were the case title insurance Co. would have to pay for the defense and liability of the legal description of your property. I don't regularly practice law in your area to but know a local lawyer that you could consult about this matter. In fact, Mr. Stevens who answered the question might be close to you so that you can speak with him about this matter.
