Legal Question in Real Estate Law in Missouri

I leased an apartment with a significant other. The lease obligation is fulfilled and we were continuing on a month to month basis. The relationship with my significant other ended and my job transferred me. I moved out of the apt. My significant other stayed in the apt. I notified the apt manager that I was moving out and asked for my portion of the security deposit back. The apt. manager is refusing to inspect the apt and to refund my portion of the security deposit until my former s/o moves out. Can the apt. refuse to inspect or refund until the other party moves out?

Unless your lease says otherwise, the landlord does not have to give any of the deposit back until the apartment is vacated. Under the facts you described, you should get your portion of the deposit back from your concentrating
