Legal Question in Real Estate Law in Missouri

partition suit in Missouri

I am wondering where I can find information on how a court decided to divide the proceeds of a sale of a home in a partition suit in Missouri.

My situation is that I bought a house about 3 1/2 years ago with my girlfriend at the time. Both of our names are on the title. She packed up her stuff and left in the middle of the day last November. She has not paid her half of the mortgage since then and threatened me with a partition suit and paying her attorney fees associated with the partition suit so I filed first to shield myself from paying her attorney fees.

Her attorney sent me a proposal with these facts:

1. We bought the house for 243K.

2. I initially put in 13K.

3. She initially put in 2K.

Before she moved out we gained approximately 3K more in equity. We paid all mortgage payments through a joint checking account that I put 65% of the money into and her 35%. (We had an agreement that she would pay half the mortgage to increase her interest in the house).

I have since built another 5K in equity. Her attorney claims she owes me nothing for the past year+ mortgage payments and that she is entitled to half the proceeds to the house. She had the house appraised at 268K and wants 20K for her share.
