Legal Question in Real Estate Law in Missouri

We purchased 4 acres of land that part of it use to be the old state hwy. We were sued in a civil case in circuit court over a land dispute. People owned acreage behind our property and never had a legal easement. During this lawsuit, the plantiff's attorney found that the State of Missouri, MODOT, never gave up ownership of the old State HWY K . We built a cabin on the property, the State still says they own. My question is, how can a person sell property they don't own ? We have an attorney and she informed us that the State can do what they want and they still own this property.

This sounds like you may have a claim against the title insurance you bought when you purchased the property. If you didn't, you may have a claim against the seller. It, you might get the State to transfer ownership to uyou.
