I signed a 13 month lease in Sept. 2010

I didn't realize it, but the contract had autorenew clause. So it renewed through Sept of 2012. Because it was odd that the first lease was 13 months and because I knew nothing about the autorenew. I gave my 30 day notice on Aug 1 with a final date of Sept. 1. They completed an inspection on Sept 4. We inquired today the 24th about the status of our deposit. We are being told that we forfeited our deposit because we did not complete the terms of the autonewed lease. They are also charging us rent for the Month of September. We left the house spotless so we should have gotten back most if not all of our deposit. And I can live with paying them rent for september. but the problem I have, it that they have already rented the home to new tennants. Is it legal for them to charge me rent (and it has clearly been defined as rent and not a penalty) if I do not have access to the home because new tenants are already there.

Based upon what you posted, it sounds like you are owed money by your former landlord. You should consult directly with an attorney in your area. Many offer a free or low cost initial consultation. You may just need help drafting a small claims complaint.
