You can probably count on the other driver's insurance denying your claim initially. You may want to retain counsel to protect your interests. You did not mention if you were ticketed for failure to provide proof of insurance. That insurance company may try to use that to justify their denial of your claim. It is a bogus defense, but it happens. let me know if you need areferral to a an attorney to represent you.

Good luck

Hi. I am an injury attorney in Missouri that focuses heavily on car accident claims, and handles cases in most parts of the state. A few additional details would be needed to determine how to proceed, in order to make sure that you obtain fair compensation for the loss of your car. Was the other driver issued any citations? Do you have a copy of the police report? Also, were you injured at all (including back or neck pain)? You will need to have an attorney assist in order to maximize the settlement amount you may receive, and fight the defenses that the other driver's insurer will raise. I would not delay at all, because decisions regarding settlements for property damage (loss of car), unlike settlements for injury, are typically made very quickly, and often times, within 1-2 weeks. I would be willing to take a look at this. For convenience, I can be reached via e-mail at [email protected], or phone at (314) 471-5585. Thanks.
