Legal Question in Wills and Trusts in Missouri

My brother is divorced, he has one son who is incarcerated for life he has no wife no children. he has a home and insist that I get everything but there's nothing in writing or a will. is this legal; also there's a civil lawsuit pending where my brother will be rewarded millions of dollars, Is this legal or can his ex-wife and son contest his wishes?

With no will, you nephew will inherit everything. If his Son predeceased him, your brothers grandchildren would be next. If there are no grandchildren, then you and your siblings will inherit. That is assuming your parents are both deceased.

There are things your brother can do to make his wishes more likely. He should consult directly with an estate planning attorney in his area. The money he is about to get will necessitate tax considerations.
