My brother and I was left a home in Missouri when my grandfather died. In the will it states that when he turns 18yrs he will be entitled to half of the home. We are suppsed to split it. We I have been living in the home the last 7yrs. He turned 18 a year ago. One of his family members are claiming that we owe him 7 yrs back rent.. Would this be the case? I have been maintaing the home and also have paid the property taxes on the home the last 7 yrs.

Yours is tricky situation. Depending upon how the will and devise were wroded, you may owe the estate for seven years of half rent, mius 1/2 of waht you have paid in taxes, upkeep and maintenence. It appears that you may owe yrou brother for 1/2 of the rent for the period after he turned 18, if he did nto have access to the property. he also owes you for 1/2 of the upkeep, maintennce and taxes since he turned 18. it woudl be easy to spend a lot of money on legal fees to sort this all out. I do not reccomend that you start a linghty legal case with your brother. You might be wise to consult direclty with an attorney in yor area who could help you resolve the issues amicably.

Good luck
