Legal Question in Wills and Trusts in Missouri

Did Father leave a will?

Father is remarried and son does not speak to new wife. How can we find out if he left a will. He verbally told son he had things he wanted grandsons to have. At funeral, wife didn't speak to any of his kids. What can we do?

Re: Did Father leave a will?

A will does nothing unless it is probated. Check with the clerk of the Probate Court in the county in which he resided and see if there is a probate file opened. If there is the will will be filed in the matter. If there is no will, the children inherit a substantial part of the estate through intestacy. If no one has opened a probate, any interested party can open probate and apply for letters of administration.
