I have been suffering from acute tendonitis from lifting and repeititve motion from working 15 years. I have been dealing with this myself but recently had an injury that has caused sever pain. Can workmem's cmp deny my claim since this has been a gradual injury?

The work comp provider can and probably will deny the claim. This does not mean that there is not a viable claim, just that you will have to get an attorney to actually file the claim for you with the appropriate court. Do not hesitate to contact my office if you would like to learn more. Thank you for your inquiry.

Hi. I am a Missouri attorney that focuses almost exclusively on workers' compensation and personal injury claims, and handles cases in most parts of the state. What type of injury occurred? Also, did you ever file a claim for the tendonitis, such as years ago when the pain first arose? If not, don't worry, that should not be a bar to a current claim based on your recent injury. A few additional details would be needed in order to determine whether the employer's workers' compensation insurer will attempt to deny your claim. Also, there are numerous requirements under the revised Missouri workers' compensation statute that employees must follow to prevent an employer from later denying the claim. When did the injury occur? For your convenience, you can reach me by e-mail at [email protected]. Thank you.
