Legal Question in Criminal Law in Montana

Forgery & Theft

My sister is being charged with one Misdemeanor count of theft and one felony count of Forgery. I do not have exact specifics but she has stolen someones name and SS# and used it to obtain funds from their bank accounts. She also did this in MI where she use to live. She opened bank accounts and credit cards in somoene's name in MI. She has not been charged I believe in MI just in Montana. She is currently in jail waiting to go to court. What can she realisticly expect as far as sentancing if she was found guilty?

Re: Forgery & Theft

The answer is, it depends. There are many factors that go into sentencing and one of the most important is the individual's prior criminal record. If this is a first felony offense, she could expect a probationary sentence, a fine, restitution, and all of the usual conditions of probation. If this is not her first felony offense, the situation worsens.
