Legal Question in Criminal Law in Montana

Gas stealing that I never intended to steal

I left a party, my friend drove me to the gas station to get 10 dollars in gas, he pumped and I went inside to write a check. It turns out my check was bad, so I asked the cashier if I could leave my drivers license with him for insurance so I can leave and try and round up 10 dollars to pay him for the gas. So we go to my buddys house so I can call my room mates to see if I can borrow 10 bucks, couldn't get a hold of him, so I waited and 10 minutes later the police arrive at my buddys house with him and the police told me I was under arrest for theft. So now they are trying to charge me with theft and now I have trial in September. How should I deal with this or what you think the outcome will be?

First, they are not trying to charge you. They have charged you. From what you say in your message, you have a defense. In my opinion you need the assistance of an attorney to work this out or take it to trial. You may be able to handle it yourself, but I suggest getting a lawyer who is competent and who practices in that jurisdiction. Seems like a lot a ten dollar misunderstanding, but you must deal with it.
