This is a "step-parent adoption." Your husband files a Petition. The biological father (1) responds to the petition and objects to the adoption or, if father does not object, (2) he can file a response saying he does not object or (3) he can simply ignore the whole process and the court will enter a default judgment.

If you need to verify paternity for child support purposes, the Child Support Enforcement Division (Dept. of Public Health and Human Services)can order a paternity test.
