full and final release in montana

my brother was assigned a conservator over oil rights in mt. the courts say i owe him money and have put a writ of execution against my oil rights check. my brother wants to release me of this claim. the courts aren't listening. how do we get my oil check released and the case closed? can he submit a full and final release himself?
