Legal Question in Personal Injury in Montana

Car accident

Last week my daughter was involved in a accident involving a pick-up truck. She was struck while crossing the street in front of our house. She was on foot. The person that hit her was not cited in the accident. Can you tell me what legal recorse I have in this matter?

The driver had a duty to keep a lookout and to drive at a reasonable speed that would allow him to stop and avoid hitting anyone in the roadway. This is even more so if the accident occurred in a residential neighborhood or near a school where kids are frequently at play or crossing the roadway. The fact that the driver was not cited has little or no bearing upon his potential negligence.

Whatever you do, you should not sign anything, especially from an insurance company, until you have had the opportunity to review this matter, and any documents, with a competent personal injury attorney. Is your daughter receiving medical care? Did you get the license and insurance information for the driver?
