i am on ss diability. i am 54. i was married to my first husband for 13 years. would i be able to collect my ss based on his income??????

It Depends

First of all, I practice in GA so please contact a local attorney. Second, you are speaking of two issues here: one, you need to qualify to obtain benefits from your ex-husband. I have written a reply about dependent benefits for an ex-wife so search the database to see the requirements for that; two, there are maximum limits as to how much Social Security Disability Insurance you receive. I do not know if you are on Social Security under Title II or under Title XVI/SSI?
