Legal Question in Wills and Trusts in Montana

Removal of Personal Representative

I would like more information on the removal of my great-grandmother's appointed Personal Representative. I believe that he is not acting in the best interests of the Estate and has frivilously funneled the assests for his personal gain. It has been seven months since her death, he has fired the Estate's lawyer (appointed by my grandmother) and we have not received an inventory of assets (nor distribution of), or expenses of administration for the Estate.

I live in a different state, and I need to know the correct procedures to remove him. This Estate is worth several hundred thousand, and I hate to see it disappear in thin air.

Thank you for your time.

Re: Removal of Personal Representative

Not knowing which state you are referring to it is

hard to say what grounds are necessary for removal.

I would call up probate court and ask what the status

is of the probate. You can receive copies of that file.

I would check to see if the estate is bonded. There are

many legal devices available to ensure the PR is doing

his or her job. You may need to seek legal advise in the

state where the probate is located. Time is of the essense.
