Can back taxes be included in the bankruptcy?

All debt which exists at the time you file is included in your bankruptcy, meaning, you must list it. If you are asking whether the back taxes will discharge in the bankruptcy, that is a separate and sticky question. Most bankruptcy lawyers will simply tell you "no" because its that sticky. To answer more fully, I'd need to know the tax year of your liability, the year you filed your return for that tax year, and whether there is any allegation that you didn't honestly file the return.
