Legal Question in Bankruptcy in Nebraska

can i put credit card debt on my chpt 7 or 13 bankrupcy in nebraska?

I need to know if I can include credit card debt in a chpt 7 or 13 in nebraska. I was told that you could no longer include credit card debt in any bankrupcy in ne.

Credit card debt can currently be included on both chapter 7 and chapter 13 bankrupcy in NE. There are some federal proposed reforms to the bankruptcy code, but those haven't yet become law--and I don't believe that they prevent writing off credit card debt, they simply make it more difficult to write off ANY unsecured consumer debts. If you are considering bankruptcy, call a bankruptcy attorney to schedule a free consultation to decide if it is right for you.

You can certainly list and must list all of your credit card debt in both chapter 7 and chapter 13 cases. Your credit card debt will be "discharged" (eliminated) in a chapter 7 case and will normally be eliminated in a chapter 13 case although discharge in a chapter 13 case is a little more complicated. In my opinion, a good lawyer should recommend you file under chapter 7 if possible. My firm files chapter 7 and chapter 13 cases in Nebraska. I am a UNL law college grad. Please feel free to call me personally to discuss your particular situation. ph. (800) 303-0720
