refund on repairs

I contacted a printer repair company to repair my printer. It didn't work properly upon return; returned it to them; again didn't work. Billed for unsatisfactory results. They asked if I'd agree to a service contract. said yes. Returned a third time for not working. They said they'd repair it while I was on vacation--still didn't work. Called to tell them so; they came to pick up the printer--I had told them to take it since I had purchased another (they had never offered to replace it or take it in trade). The owner called me back and asked what he could do to make this better. I told him he could pay me for the ink in the printer--$400. He said okay and would also reimburse me for any other charges he thought appropriate. Since that call, nothing has happened. I called again this morning and now he says he only agreed to pay me for the ink in the printer--about $150 worth. He also said he couldn't let the cost of the service agreement slide. The problem is, he has my old printer (he says is working flawlessly), and he still wants me to pay the service contract cost, $300. I'm still making payments on the old printer, too. Technically, the old printer is still mine, but I refuse to pay for the service contract or expenses.

Not really a question; more of a general complaint. It seems you are not happy and want to share the unhappiness with someone else by not paying them. You seem to make impulsive decisions which often translates to expensive decisions. You say you refuse to pay for the service contract you agreed to and repair bills for work performed at your request. If you are serious and determined, then chances are you will soon be hearing from a collection agency or will receive notice that a suit has been filed against you. If you decide to hire an attorney to learn whether or not you may have a valid reason to refuse payment, it will probably cost you $200 or more just to learn what your options are, depending on the facts you can prove and the terms of the contracts you signed. The answer may be that you have no legal defense. If you file a small claims action, the ruling may be against you. If you can sit down calmly with the owner of the repair service and explain your frustrations, you may be able to negotiate a solution that doesn't hurt too much. Remember, it was your decision to go buy the second printer not his; it does not excuse you from the service contract. I would recommend the last solution; talking with the repair shop owner. It is likely to be cheaper and offer much less frustration than if you simply decide to ignore your obligations.
