Legal Question in Credit and Debt Law in Nebraska

Two summons for same bill

Hello,

I received two summons for the same bill from two different attorneys who represent two different creditors. What do you recommend in terms of handling this situation? I am not wise in such things, but this sort of practice seems a bit unethical.

Thanks for any advice you can provide.

Re: Two summons for same bill

I assume you mean two different collection agencies, but one original creditor?

You can try informally resolving the issue by sending both attorneys a copy of the other's suit and demanding that they drop one. If that doesn't work, and one of the attorneys gets a judgment against you, you can use that as a defense in the second lawsuit against you. As long as you can prove this is truly the same debt, the Court won't let them collect twice on it.
