Legal Question in Discrimination Law in Nebraska

My Men Scrawled Racial Epitaph On Break Room Sign

I am a Captain in a police department with about 600 men in the department. A little over a month ago a racial epitaph allegedly derogatory to African Americans (unless they use it, which the do all the time).

Since the incident occurred at the Northeast Precinct Station in a predominantly black part of town with an equally dominant black police pressence, quite a big deal has been made of this incident. The mayor and city council both want a federal investigation as to who wrote the word on the break room sign in the secured ''police only'' breakroom at the precinct house.

One of my men wrote the word. I know who it is. He will undoubtedly claim I forced him to write it once he gets caught as he knows I know his identity.

My question is can I be fired despite not being arrested for the crime? Can my officer be arrested? Isn't the word, ''nigga'' used all the time in society without reprocussion? Thank you.

Employment as a police officer in many cities is subject to a collective bargaining agreement. You should consult with the attorney for the FOP.
