Legal Question in Family Law in Nebraska

Dissolution of a guardianship

About 8 yrs ago I gave guardianship to my parents, My sons grandparents. I do not like the way my parents are raising my son any longer and I am getting sick of the fact that If I do something wrong I get grounded from seeing my child. I want to take them back to court to disolve their guardianship of my son. As long as they do have guardianship am I still allowed to make certain parental decisions for my child. Do they have to inform me if they need to take him to the hospital for emergency care. Can they prevent me from taking my son to see his other grandparents in a neighboring state. PLEASE HELP!!!

Re: Dissolution of a guardianship

You can petition to have the guardianship removed. You will want to see someone who specializes in Family Law. This isn't an area of the law that is "do it yourself" friendly so you will need to have an attorney help you through the process.

Parenting decisions are tricky in these situations--much like in a divorce. You should be part of the decision making process, but generally the person with custody gets the final say. As for hospitalizations, part of the reason for signing guardianship papers is so that the guardians can get emergency medical care. You have the right to know of the care and to inspect medical records.

My best advice to you is to see a Family Law attorney and get the process started.
