Legal Question in Wills and Trusts in Nebraska

How to avoid involvement in parent's debt ridden estate

My fathers accounts (utilities, credit cards) are in poor standing and I think he is probably upside down on his home mortgage. He wants to leave the house to me as well as all his ''assets'', of which there are very few.

I do not want to inherit a mortgage. No will has been drawn up and he wants to write a holographic will. How can I extricate myself from this? Can I deny acceptance of an inheritance?

You do not have to accept an inheritance. Sometimes after a person dies debt is not pursued by creditors.

But, no, you do not have to accept an inheritance.

Just be kind to your father and let him do what he wants. When he is gone, you can decide whether or not to open probate or accept the inheritance. Don't make that decision now, he may win the powerball next week. Allow your father to feel good about offering to leave you something, even if it turns out to be nothing. You are never obligated to accept an inheritance.
