Can i Persue a ex partner for development of my project without my consent?

I have a ex programmer developing a program that Ive been developing for over 3 years. This is the binding clause in my nonedislosure;

The excution of this agreement by both parties shall enable the principal to provide the potential partner with the details of the company and the details and ideas for its successful operation in the market place. as a condition imposed upon the potential partner who signs this agreement, the potential partner shall be precluded from developing, producing, distributing, pantenting or otherwise using the ideas and/or concepts associated with the company and/ or the principal, for his own personal gain or that of another without the expressed written consent of the principal.

I signed a nondisclosure believing he had somthing new.My doc's are timelined

Absolutely based upon the Agreement you should be able to get money from him and based upon the language of the agreement, get an injunction. However, it will not be be cheap. I will give you a free consultation to discuss.
