Legal Question in Consumer Law in Nevada

Reposession of Car

I have been attempting to buy a car, there are some credit issues due to a bank's error. I had the car in my possession since June. The dealer stated they were unable to get me financed unless I did some things, which I did. We had signed a contract in June at that time they told me I was financed. I did tell them I was a travelling nurse and would be leaving for Arizona in 2 weeks. This did not seem to be a problem. They then said that they had finally financed me and sent me another contract on Thursday to sign which I did and my first payment was to be by October 16, I have been saving the payments for the car so I could make them when the financing was done. I woke up this morning and my car was gone. I thought it had been stolen because I had not received any letters/calls from them saying they were repossessing. My question is how can they do this when I have fulfilled all my obligations and had not recieved any notices on where to send payments. I called the dealer and they cannot tell me where my car is. My purse was in the car and I cannot even rent a car without my driver's license.

Re: Reposession of Car

If the dealer signed the contract and gave it to you, they have sold the car and are the creditor unless they rescinded the deal within 14 days. From your message it would appear that the dealer failed to rescind within the 14 days and it is their problem if they cannot sell the paper.

Someone needs to review all of your paperwork to give you better advice concerning your remedies.

You need to make a theft report to the police and your insurance co.

You did not mention whether you made any down payment or if the dealer took a trade-in from you. That would raise additional issues.

You can schedule a consultation if you want to pursue this. 614-3388.
