I am charged with obtaining $ under false pretenses

I changed a tag at Macy's and paid $95 for a $300 sweater. I am wondering will I go to jail for this crime? Also, I was never read my rights when I was arrested,

If this is your first offense it will probably be reduced to a misdemeanor.

If the offense was in California and you don't have any prior theft offenses, then the offense is only a misdemeanor. The maximum amount of time that you can be sentenced for a misdemeanor is one year in the county jail or a $1,000 fine or both. Whether or not you actually spend any time in jail depends on the judge, the District Attorney and your attorney. Because it is a priorable offense, meaning a conviction of this offense can increase the penalties of a similar future offense, and it is an offense that can have immigration consequences if you are not a citizen, you should seriously consider being represented by an attorney.
