Child support Burden of Proof

My ex is taking me to court for arrears for child support. She claims I owe more, but my records reflect something different. Some of my records are money orders and canceled checks, but I don't have the proof that I paid. Who has the burden of proof, and is it up to the judge?

Thank you for your inquiry.

In examining a child support arrearages petition it is best to look at it in terms of what have you paid during the alleged time period. If you have a signed agreement outlining your child support obligation it would be easy to calculate owed payments and your records would act as an offset.
