Child would like to switch homes

My husband has two children through an ex wife. When the ex wife sent the oldest to use we went to the court and got custody no problem.. but that was in KS. We now live in NV near the ex wife... and the youngest son is telling us he wants to live with us.. Once we saw bruises and was told that the ex wifes boyfriend was the cause... but she wouldnt let us have the child for pictures... The ex wife used us to get her out of her house and we took the son for a few days just a matter of weeks after the bruises... but she went back to him soon after. We would like to know what to do and if there is any way that we can get custody of the youngest. Not to mention that the ex wife is receiving two hundred dollars a month to go to the youngest child, but he is growing out of his clothing and we are having to purchase this for him because she does not have the money for it. Please let us know your advise. We love our son and are afraid he is going to grow up Very unhappy. He tells us everyday that he wants to be in our home...

You need to file a motion for change of custody. However, you will have the burden to show that it is substantially in the best interest of the younger child to have a change of custody. I would suggest you consult a family law attorney.
