Your ex-husband cannot avoid your visitation requirements as established by a Court Order. If he fails to do so, you may file a motion for the Court to hold him in Contempt. If the Court so finds, he/she has the ability to modify the custody and visitation arrangement established in the original decree.

Your ex-husband would be able to avoid his driving at night only if he has a valid medical reason supported by a physician. If so, you still should reapproach the Court to modify your visitation to accomodate your ex-husband's condition.

Write him a letter telling him that you will take him back to Court for being in Contempt of Court in sabotaging your visitation rights. Unless he has a medical excuse, his excuse is not good.
