Legal Question in Family Law in Nevada

I am the custodial parent and I wish to relocate out of state the non-custodial parent is aware but has not yet given me his consent and it has been 4 months. I'm afraid I may have to petition the court for permission, as the time I wish to leave is getting closer. I have no idea where to start and cannot afford an attorney. What forms do I need to file and what sort of information will I need to provide the court with?

You would need to file and properly serve adn set for a Hearing, a Motion to Relocate Outside of the State of Nevada with Minor Child. I do not believe that there is a "form" for this at the Self Help Center.

You will need to prove your case to the court. You will have to explain why the move is necessary, what efforts you undertook to get consent, what has the visitation schedule been like since you and your ex broke up and what will you do to make up for your ex's lost visitation if you are allowed to move. Also, you should explain how travel will work and who will pay the transportation costs. These are only some of the things you need to argue for your case.

You must argue the facts and the law. Your ex does not have to grant you permission to move and the court doesn't either. It is discretionary.

I wouldn't wait too long as it isn't always easy to get a court date.
