Legal Question in Family Law in Nevada

Family Court Custody Issue

In May my son who is of age had a friend spend the night and the next morning was found overdosed in the room. I started CPR and called 911. The girl died. CPS took my kids and one of my exes had me sign a letter stating it was ok to leave the state with her. I did not have a visitation schedule in place and want to one now...he is not cooperating at all. 1st what would justify CPS removing my kids from my house and 2nd what do i need to do to force a parenting plan to visit here or there? Where can I find CPS procedures or protocols? ANy help...please

Re: Family Court Custody Issue

CPS is authorized by the Nevada Revised Statutes to do what is in the best interest of children in this state. You would need to file a motion for visitation in the Court that has jurisdiction of you child.

Re: Family Court Custody Issue

CPS has the authority to take temporary custody of children if they feel it is in the best interests of the child to do so.

If you wish to establish vistitation schedules for your children, you will need to file a formal petition with the Family Court in Clark County.

I would highly recommend you retain the services of an attorney to aid you in this process. If you would like to speak to an attorney in my office contact us and we can set up a free initial consultation.
