Legal Question in Family Law in Nevada

Fathers rights - on or off birth cert.

I am not married to my (un-born) baby's father but, we are on fairly good terms. He has not been around during entire pregnancy and now that it is time for the baby to be born, he is interested in her. I am debating whether or not he should be on the birth cert. I do not want a battle of custody later on. I also want to consider whats best for the baby as far as child support, social security benefits later on, insurance, etc. He is alot younger than I am and I make more money than he does and would provide a much better environment for her than he ever could. I would like to always remain as #1 decision maker as far as her well-being. What do you suggest? Thanks for any input. By the way, she is due on Thursday, November 2. Any help is appreciated greatly!

Re: Fathers rights - on or off birth cert.

Whether you chose to have your baby's father's name listed on the birth certificate ultimately means little in regards to custody. In other words, your choice in that regard doesn't dictate the father's rights (he has those rights simply by being the father), and he can always go to court to enforce those rights should you choose to arbitrarily decide that he doesn't get to see the child or participate in her life.

My suggestion is to be grateful for having someone in your life, with whom you have already acted in concert with to create a new human being, who actually desires to participate in his child's life. Share the child with him so that your child grows up knowing both her parents, that is best for her in the long haul.

If you have doubts as to the paternity of the child, then by all means seek a paternity test before making the decision to place the putative father's name on the birth certificate, which in some circumstances can operate as a waiver to later denial of paternity.
