Legal Question in Family Law in Nevada

marriage of minor

43 years ago my husband and I got married in Reno. However, I was 16 years old and used a document stating I was 18 for i.d. Since my parents never contested the marriage, we assumed it was legal. Now we find we may not be legally married. Anything we should do to remedy this?

Re: marriage of minor

You could get an annulment and re-marry, but I would not bother.

Family code section 2210(a) applies to your situation. The marriage would have been voidable until you both were old enough to consent to marriage. By continuing to live as husband and wife after reaching the age of consent the marriage became valid. below is a copy of that code section:

(a) The party who commences the proceeding or on whose behalf the proceeding is commenced was without the capability of consenting to the marriage as provided in Section 301 or 302, unless, after attaining the age of consent, the party for any time freely cohabited with the other as husband and wife.
