mothers rights

my husband and i have been married for 18 years we have two children--name removed--one 18 and the other is14 i am going to leave my husband and i want to take my daughter with me can he stop me legally?

He cannot stop you. If you are going to stay in Nevada there is nothing he can do but if you leave Nevada after the divorce is filed, you would need either his permission or the judge's permission to move outside of Nevada.

You have the right to file for divorce. If you wish to retain custody from your husband, you are going to need to file formal custody papers in Family Court. Your husband has the ability to file an opposition if he so desires. If you file for divorce and custody uncontested you should get all desired conditions.

There are other issues involved in a divorce including child support, alimony, and other issues. I always recommend that individuals consult with an attorney before filing formal paperwork.
