Legal Question in Family Law in Nevada

paternity and birth certificate

I am an unmarried woman who has just given birth. My boyfriend at the time, had gotten me pregnante, but left soon after to be with his other child in another state. Between the time he left and the time the baby was born, I had gotten engaged to another man who I plan to marry shortly. I have few a questions to ask. First can I have my current fiance sign his name to the birth certificate rather than the biological father? I also want to give my child my fiance's first and last name even though we are not married yet. Is that allowed? Can I do that? What is the biological father's rights in this issue? What are my rights? The biological father wants to be a part off this child's life and will fight it, if I try to raise my son the way I want to. Can you please help me, I have know idea what to do and neither side seems to want to comprise.

Re: paternity and birth certificate

You should not have your current boyfriend sign the birth certificate claiming that he is the biological father if in fact he is not the father.

The birth certificate is a legal document. Nor should you name the child with your current boyfriend's last name. You should file a Paternity case and have the court legally recognize your rights and address the name of the

child in a formal manner. If you attempt to circumvent the legal procedures

for naming the child and possibly adversely effect the biological father's

rights, he may have more support for his case.
