prenuptial agreement

Husband made me sign a prenup less than 24 hours before wedding which was reviewed by a lawyer but I signed anyways after fiance threatened to send family home. I am fighting the prenup now as husband had affair. Does he have to pay spousal support in the interim of this case? If he breached his prenup contract twice is it possible to have it thrown out?

The Judge would have to decide if there was fraud or duress at the time the pre-nupt was entered into. Insofar as him breaching the pre-nupt that is a different issue. The judge would not throw it out but perhaps award some other type of remedy like temporary alimony.

Whose lawyer reviewed the pre-nup? If it was your lawyer, it is more likely to be enforced. There is duress in your signing it as every one was prepared to go to a wedding and therefore, that is an issue.

In order to give better advice, I would need to see the pre-nup.
