Legal Question in Family Law in Nevada

If my wife has only filed for Legal Seperation in Caslifornia where she is not a resident yet for 5 more months, can i file for Divorce in Nevada where were both concidered residents?

You can but she has beat you to the punch if you ever lived as husband and wife in California. If you did live in CA but file in Nevada, the Nevada judge should still give you a divorce because your wife cannot get a divorce until she has lived there for a total of six months. If your property is all in Nevada, ie. house, the California judge may defer because California has no jurisdiction over real estate.
