Car Vandalism

Recently my parents vehicle was vandalised by someone unknown to them. The suspect used a large rock that was readily available in the casino's rock garden in their parking lot.

The person committing the act was witnessed by at least one person (who initially called the police).

Also the suspect was just recently kicked out of the casino due to vandalization of their property.

The casino has the act on camera, and has the man on camera in their casino vandalizing their machines.

The police have not yet formally arrested this man and according to other people I have talked to this man is a repeat offender of this same crime.

My question is do we have any legal recourse from the Casino as the vehicle was in their lot and they knew that this man was already in an upset state?

Do we have any legal recourse to seek damages from this suspect even if he is not found guilty by the court for the crime?

Typically, casino properties post notices and disclaimers telling their patrons that they are not responsible for damage or theft that occurs on their property.

An exception to this would be if you can prove that the casino was on notice of the vandal and impending damage and failed to stop it. In that case, you may have a case against the casino for negligent training and supervision of their security.

As far as the vandal, you clearly have a civil case against him and can bring such a case independent of any criminal charge.
