can I sue someone if they recommend a person to do business and they promote that person or business but down the road come to find out the person they had recommended or endorsed was fraud? what element of law will that fall under? what type of law suit should I file

It is hard to say where this would go without knowing more facts about the matter. On its face, if you were defrauded by someone, your hope for recovery is against the one who committed the fraudulent acts, not against someone who recommended him/her. Can you show that the referring party benefited in some way from the misdeeds of the culpable person? Was there some sort of referral fee or finder's fee or other compensation paid to the one who gave you the miscreant's name? In making the referral, did they lie to you or misrepresent the credentials of the person who victimized you? Unless they were unfairly enriched in some way by their recommendation, they can simply say they knew nothing of the fraudulent intent and had nothing to do with it.

I think you are stuck with trying to chase down the one who actually ripped you off, rather than the one who may have initiated and encouraged the relationship that ended up damaging you.
